Privacy Policy – Car Junction

Subhash Nagar, Alwar, Rajasthan, India, 301001 (“Farmjunction Company”), its subsidiaries, affiliates, sister concerns, representatives, and contractors for the purpose of collecting, processing, protecting, storing, transferring, and utilizing the Information (as defined hereinafter).

1.3. Specifically, and for the avoidance of doubt, this Policy shall govern Your use of and interaction with the Company’s platforms including but not limited to the below:

This Privacy Policy is intended to provide You with information on how We collect, use, and protect Your personal information and sensitive personal data or information (“Information”) in compliance with the Information Technology Act, 2000, and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information data or information) Rules, 2011 (“SPDI Rules”) and, as applicable, the Digital Personal Data Protection Act, 2023 (“DPDPA”) and the rules made therein as notified from time to time. (c) We may contact You using Your email id or mobile number to share various products and Services that may be of interest to You or to address queries or resolve any concerns You may raise. We process the above Information based on Our legitimate interest in undertaking marketing activities to offer You Services that may be of Your interest.

(d) You can ask Us to stop sending You such marketing communication at any time by: (i) clicking on the opt-out link in the email sent to You; (ii) changing Your notification settings in Your account; or (iii) by stating to Our calling agent that You do not wish to be contacted for the above marketing communications.

(a) We use Your mobile number, log data, and unique device identifiers to administer and protect Our websites (including troubleshooting, data analysis, testing, fraud prevention, system maintenance, support, reporting, and hosting of data).

(b) To prevent and detect fraud on Our Services, We make use of algorithms that recognize suspicious or fraudulent user behaviour based on certain information, such as user activity and posted content, which may lead to Us banning certain user accounts. Automated banning happens when there is a very high degree of certainty that an account or action is fraudulent. Your consent under this Policy expressly permits the Company to collect, receive from authorised sources, store, process, use, and share in accordance with this Policy all related data, including but not limited to dependent/associated individuals’ details, vehicle registration particulars, insurance policies and certificates, fitness/PUCC, transfer certificates, service/maintenance and repair history, accident history, odometer/usage records, OEM specifications and modifications, vehicle history data, and any other related or reasonably foreseeable data required for current or future business operations or services of the Company.

6. JOB APPLICANTS

If your Information is submitted to us through our Service when applying for a position with Our company, the information will be used to consider your application. We may retain your Information for any period of time. This Information may be shared with other companies for the purpose of evaluating your qualifications for the particular position or other available positions, as well as with third-party service providers retained by us to collect, maintain and analyze candidate submissions for job postings.

7. PERMISSIBLE AGE

The Services are not intended for users under the age of 18, unless permitted under applicable local laws (Permissible Age). We do not knowingly collect any personal information from users or market to or solicit information from anyone under the Permissible Age. If we become aware that a person submitting personal information is under the Permissible Age, we will delete the account and any related information as soon as possible. If You do not agree with the way We are processing Your personal data and the choices We are providing to You, You may close Your account at any time by going into Your account settings and select delete account.

9. DATA SECURITY

9.1. The Company has implemented and maintains reasonable security practices and procedures, including administrative, physical, and technical safeguards, to protect Your Information from unauthorized access, use, disclosure, alteration, or destruction. These include robust administrative, physical, and technical safeguards such as encryption, access control policies, firewalls, and regular security audits to protect Your Information against unauthorized access, disclosure, alteration, or destruction. Our security measures are in compliance with the SPDI Rules and the DPDP Act (to the extent applicable) and are regularly reviewed and updated.

9.2. Please note, despite the measures We have implemented to protect Your Information, the transfer of Information through the internet or other open networks is never completely secure and there is a risk that Your Information may be accessed by unauthorized third parties.

10. YOUR RIGHTS

You may exercise the rights set out below in respect of Your Information, subject to applicable law and the terms of this Policy.

(a) Right to Not Provide Information: You have the option to not provide the Information requested by the Company. However, please be aware that failure to provide Information that is essential for the provision, operation, or administration of the Services may prevent the Company from offering certain Services to You or administering its relationship with You effectively.

(b) Right to Access and Portability: You have the right to access your Information and request a copy of Your Information from the Company for sharing with third parties.

(c) Right to Review and Correct: You have the right to review the Information You have provided and to request correction or amendment of any inaccurate or deficient Information. Such requests may be made either through Your account on Our website or in writing to Our grievance officer.

(d) Right to Withdraw Consent: You have the right to withdraw Your consent at any time by submitting a written request to the grievance officer. Upon withdrawal, the Company will cease to process unless such processing is required under applicable law.

(e) Right to Request Deletion (“Right to be forgotten”): You have the right to request the deletion of Your personal data at any time by submitting a written request to the grievance officer. Upon receiving such a request, the Company will cease to retain and will delete Your Information, except where retention is required under applicable law.

11. DATA RETENTION

11.1. Your Information will be stored for such period as may be required by applicable laws or as necessary for the Company’s legitimate business purposes and record-keeping requirements.

11.2. Your Information shall be deleted or anonymized in the event the Company ceases to have a legitimate business or legal requirement for processing Your Information.

11.3. In case the Information cannot be deleted (for example, due to storage on backup archives), the Company shall endeavour to securely store the Information and isolate it from further processing until deletion is possible.

12. DISCLAIMER

In case any personal data is shared by You with Us, which is not requested by Us during registration (whether mandatorily or optionally), We will not be liable for any personal data breach or disclosure in relation to such data.
